The Failure of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the announcement of a new comprehensive peace framework for achieving ceasefire appeared – temporarily – to have been contained. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of contrasting events captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: hopeful statements are released from different nations. Considerable effort is devoted on restraining particular approaches. By night, Russian leadership brutally reminds the world that, for them, war remains the main instrument for achieving "peace".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is capable of detecting rocket firings from across the border, a capacity enabled by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to intercept incoming aerial threats flew past – modern combat jets provided to Ukraine by European allies.

Moments later, Kyiv's air-defence systems thundered: multiple launches deployed against a incoming threat. This was a modern interception technology at work, probably supplied through partner states. Every firing shakes the surroundings, rattling buildings. The moment of terror quickly transforms into grim resignation: maybe the hostile projectile won't hit its mark this time, sparing the city from ruin and additional electricity failures.

Ongoing Risks

Soon after, a heavy machine gun fired at a unmanned aircraft close by, part of a mobile-fire group – almost certainly Western-made equipment. Unfortunately, the shots failed to hit the enemy aircraft – it continued its flight toward its target.

Intermittently, this carried on until dawn. Kyiv greeted the daybreak reports: several casualties, devastation and utility failures in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still continued their routines – enduring hostilities. But those entire period demonstrated Ukraine's vital need on international aid – a reliance that European nations are clearly incapable to fill in the near term.

Ineffective Peace Efforts

The comprehensive proposal from US administration sparked intense emotion, discussion and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after earlier high-level meetings and international summits.

Every new proposal from US leadership adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually achieve victory. This cycle will, undoubtedly, continue.

Political Considerations

It is convenient to criticize specific actors of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a assumption well known to international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The American government believes that it is unrealistic to compel Moscow to surrender the land that it already controls in Ukraine's south or east.

The challenge is that while acknowledging this situation, American administration does little to discourage Russia, through statements or actions, from assuming that the status quo will not evolve additionally in its benefit in the coming year.

Opposing Positions

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its allies are nearing depletion. Their reason to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to stop fighting, but they will persist as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, gradually sacrificing lives and land but averting a total frontline collapse until situations evolve in its advantage.

Current Realities

Factually, there are no real preconditions for a ceasefire. Now, subjective factors are becoming relevant: leadership ambitions to broker a ceasefire and secure international recognition, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any proposal Kyiv finds unworkable, so that their focus does not shift toward internal issues. And although their mission will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These opposing factors are driving the talks.

Conclusion and Outlook

It took a only one week to kill the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, pushback by Ukraine and the other European countries, along with soothing efforts of diplomats, and finally, latest revelations, all achieved their purpose.

While new plans based on previous concepts are forthcoming, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are rooted in Kremlin requirements and show certain reluctance to alter the situation, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, largely rely on sustained allied backing.
